TERMS OF USE & SALE
Please read these Terms carefully before placing an order or using this website. By accessing this site or completing a purchase, you agree to be bound by these Terms.
1. ABOUT US
ONE OF ONE is an Israeli botanical art studio founded and operated by Amiyah Michaeli-Menashe. We create original artworks and limited-edition
prints using real wildflowers collected from the hills of Israel, pressed and preserved using traditional techniques. All orders are shipped from our studio in Israel.
2. PRODUCTS
2.1 What We Sell
We sell original artworks, limited-edition giclée prints, framed prints, unframed prints, and small handmade objects including pressed flowers on glass, ceramic tiles, pressed flowers on fabric, bookmarks, and gift cards.
2.2 Botanical Material
All botanical material used in our products consists of real dried wildflowers collected from the Jerusalem Hills and surrounding areas in the Land of Israel. Some of the flowers were collected in other places, which are all mentioned in the product description. Each flower is collected, pressed, and preserved by the artist by hand. Original Products are not mass-produced.
2.3 Natural Variation
Because our original products use real botanical material, no two pieces are identical. Minor natural variations in color, size, and arrangement are
part of the work, not defects. Product photographs represent the actual item as accurately as possible.
2.4 Allergen Notice
Our original products contain real dried plant material. If you have known allergies to specific plant species, please review the product description
carefully before purchasing. ONE OF ONE is not responsible for allergic reactions resulting from contact with botanical materials.
2.5 Limited Editions
Print editions are limited to 200 copies per design. An edition number and certificate of origin are included with each print shipment.
3. ORDERS AND PAYMENT
3.1 Placing an Order
By completing checkout, you are making a binding offer to purchase the selected items at the listed price. We reserve the right to decline or
cancel any order at our discretion, in which case a full refund will be issued promptly.
3.2 Order Cancellation by the Buyer
You may cancel your order within 24 hours of placing it, provided the item has not yet been dispatched. To cancel, contact us at oneofone.flora@gmail.com with your order number. After 24 hours or after dispatch, cancellation is no longer possible. Returns are governed by
Section 6.
3.3 Prices
All prices are listed in US dollars (USD). Prices are subject to change without notice. The price confirmed at checkout is the price you will pay.
3.4 Payment
We accept payment via credit card (processed by Max) and PayPal. By submitting your payment details, you confirm you are authorized to use the payment method provided.
3.5 Sales Tax
Sales tax is not currently collected at checkout. Buyers may be responsible for any applicable use tax or sales tax obligations under their local laws
3.6 Currency
All transactions are processed in US dollars. Your bank or payment providers may apply currency conversion fees for non-US accounts. One of One is not responsible for those fees.
4. SHIPPING AND DELIVERY
4.1 Shipping Origin
All orders ship from our studio in Israel via Israel Post or international courier (FedEx or equivalent). We do not ship from a warehouse in the United States.
4.2 Processing Time
Orders are processed within 7 to 10 business days of payment confirmation. Handmade and original items may require additional preparation time, as
noted in the individual product listing.
4.3 Estimated Delivery Times (after dispatch)
Standard international mail (EcoPost): 14 to 21 business days.
Express courier (FedEx or equivalent): 7 to 14 business days.
Delivery times are estimates. We cannot guarantee delivery dates due to factors outside our control, including customs clearance, carrier delays, and public holidays.
4.4 Tracking
All shipments include a tracking number, provided by email after dispatch.
It is your responsibility to monitor the shipment using the provided tracking number.
4.5 Shipping Address
Please verify your shipping address before completing your order. ONE OF ONE is not responsible for items delivered to an incorrectly provided address. Address changes after dispatch may not be possible.
5. CUSTOMS, DUTIES, AND IMPORT TAXES
5.1 Buyer Responsibility
ONE OF ONE ships on a Delivered Duty Unpaid (DDU) basis. Import duties, customs fees, and any applicable taxes levied by your country's customs
authority are the sole responsibility of the buyer. These charges are not included in your purchase price or shipping fee and are collected at delivery by your local customs authority.
5.2 US Import Rules
Our products consist of dried botanical material that has been pressed and preserved for several weeks before shipment. Buyers are responsible for ensuring that imported items are permitted under their country's import regulations. ONE OF ONE cannot guarantee that all products will clear customs in every jurisdiction.
5.3 Customs Delays
Customs clearance is managed by your country's customs authority and is outside our control. ONE OF ONE is not liable for delays caused by customs
processing.
5.4 Refused or Returned Shipments
If a shipment is refused or returned due to unpaid customs duties or incorrect information provided by the buyer, the cost of return shipping
will be deducted from any refund issued.
6. RETURNS AND REFUNDS
6.1 Return Window
We accept return requests on eligible items within 14 days of confirmed delivery. To initiate a return, contact us at oneofone.flora@gmail.com
within 14 days of receiving your order. Include your order number and photographs of the item.
6.2 Eligible Items
The following items are eligible for return if received in original, undamaged condition:
- Framed prints (see Section 6.3 for conditions)
- Unframed prints
- Bookmarks
6.3 Returns on Framed Prints
Framed prints may be returned within 14 days of delivery, subject to the following conditions:
- A restocking fee of 15% of the item price applies.
- The buyer is responsible for return shipping costs, including full insurance coverage for the value of the item.
- Items must be returned in their original packaging with adequate protection for international transit.
- A refund (minus the 15% restocking fee) will be issued only upon receipt of the item in its original, undamaged condition. Items that arrive back damaged due to insufficient packaging will not be refunded.
6.4 Non-Eligible Items
The following items are not eligible for return:
- Original artworks (one-of-a-kind pieces)
- Handmade objects: pressed flowers on glass, ceramic tiles, pressed flowers on fabric
- Gift cards (digital, delivered by email)
- Items marked as final sale
6.5 Return Shipping
For all returns, the buyer is responsible for the cost of return shipping.
We strongly recommend insured shipping for any return sent to Israel.
6.6 Refund Processing
Once a returned item is received and inspected, we will notify you of the refund decision within 5 business days. Approved refunds are issued to
the original payment method within 7 to 10 business days.
6.7 Damaged on Arrival
If your item arrives damaged, contact us within 48 hours of delivery with photographs of the item and the packaging. We will either replace the item
or issue a full refund, at our discretion. Do not discard the original packaging until the claim is resolved.
6.8 Lost Shipments
If your shipment tracking shows no movement for more than 30 days past the estimated delivery date, contact us and we will investigate.
Resolution options include replacement or refund depending on availability and circumstances.
7. GIFT CARDS
7.1 Delivery
ONE OF ONE gift cards are delivered by email to the recipient's email address provided at checkout. Delivery is digital only. No physical card
is shipped.
7.2 Validity
Gift cards are valid for 12 months from the date of purchase. Unused balances after the expiry date are forfeited.
7.3 Redemption
Gift cards may be redeemed on this website only. They cannot be redeemed for cash, exchanged for other gift cards, or applied to previous orders.
7.4 Non-Refundable
Gift cards are non-refundable after delivery to the provided email address. If a gift card email is not received within 24 hours of purchase, contact
us and we will resend it.
7.5 Lost or Stolen
ONE OF ONE is not responsible for gift cards that are lost, stolen, or used without authorization after delivery to the provided email address.
8. INTELLECTUAL PROPERTY
8.1 Ownership
All content on this website, including product photographs, written descriptions, artwork images, design elements, and copy, is the exclusive
property of Amiyah Michaeli-Menashe and ONE OF ONE Studio. All rights reserved.
8.2 Sharing and Social Media
We love seeing our work in your home. You are welcome to share photographs of your purchased items on social media for personal, non-commercial
purposes. We would be delighted if you tag us at @oneofone.flora. Commercial use, reproduction, or modification of any content requires
prior written permission from ONE OF ONE.
8.3 Purchased Works
Purchasing a print or artwork grants you ownership of the physical object only. It does not transfer copyright, reproduction rights, or commercial
use rights in the artistic work depicted.
9. PRIVACY
Your use of this website is also governed by our Privacy Policy. By using this site, you consent to the data practices described in the Privacy Policy.
10. ACCURACY OF INFORMATION
We make reasonable efforts to ensure that product descriptions, pricing, and availability information are accurate. In the event of a material
error, we reserve the right to cancel the affected order and issue a full refund.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, ONE OF ONE and Amiyah Michaeli-Menashe shall not be liable for any indirect, incidental,
consequential, or punitive damages arising from your use of this site or purchase of our products, including but not limited to delays in delivery,
missed occasions, or damage caused by third-party carriers.
Our total liability for any claim arising from a purchase is limited to the amount paid for the specific item or items involved. Nothing in these Terms limits our liability for death, personal injury, or fraud caused by our own negligence.
12. GOVERNING LAW AND DISPUTES
12.1 Governing Law
These Terms are governed by the laws of the State of Israel. If mandatory consumer protection laws in your jurisdiction provide you with rights that
cannot be waived by contract, those rights are not affected by this clause.
12.2 Dispute Resolution
We prefer to resolve disputes directly and promptly. If you have a complaint, please contact us first at oneofone.flora@gmail.com. We commit
to respond within 5 business days.
12.3 Chargebacks
Before initiating a chargeback with your payment provider, we ask that you contact us directly. Most issues can be resolved quickly without
third-party involvement.
13. CHANGES TO THESE TERMS
We may update these Terms at any time. Changes take effect upon posting to this page. The "Last updated" date at the top reflects when the current
version was published. Continued use of this site after changes are posted constitutes acceptance of the revised Terms.
